1.      Definitions & Interpretation In these Terms & Conditions:
1.1.   “Event” means the Lyme Splash Sea Water Polo Tournament 2026 (or any related sessions) organised by the Organiser.
1.2.   “Organiser” means Lyme Splash Water Polo Ltd. and any of its authorised officers, agents, contractors or representatives. “We”, “Us” and “Our” shall be read accordingly.
1.3.   “Tickets” means evidence of registration (electronic only) granting the right to participate or attend the Event.
1.4.   “Venue” means the sea-water location(s) and any associated facilities where the Event is held.
1.5.   “You” means the person registering (or the team representative) and includes anyone acting with Your authority or permission. “Your” shall be read accordingly.
 
2.      Registration
2.1.   You must be at least 18 years of age to register a team or participate, unless otherwise stated for specific categories. Participants under 18 must have the prior written consent of a parent or legal guardian, and must be accompanied at the Event by a responsible adult. 
2.2.   All details You provide during registration must be accurate, complete and kept up to date. 
2.3.   You must promptly notify Us of any changes to Your contact details (email, phone, address) via the registration platform or by emailing [email protected] to ensure effective communication.
2.4.   By registering, You confirm that You (and all Your team members) participate in sea-water polo entirely at Your own risk. The Organiser provides information and facilities but does not assume legal responsibility for decisions to participate or for information supplied. 
2.5.   By registering for the Event, You declare that You will comply with all Event rules, Swim England Water Polo Regulations, and safety requirements. As the team representative, You agree to the following on behalf of Yourself and all team members:
2.5.1.  You are registering a team on behalf of a Swim England-registered club. 
2.5.2. Every player will be a current Swim England “Compete” level member and medically fit to participate in sea-water polo. 
2.5.3.  All details provided in registration forms are correct in every respect. 
2.5.4. To the extent permitted by law, the Organiser, its officers, agents, sponsors, contractors and affiliates shall have no liability for any injury, loss, damage (including consequential loss) suffered by You or any team member in connection with the Event. 
2.5.5. Swimming/playing in untreated open sea water carries inherent risks, including (but not limited to) bacterial/viral infections, stomach upsets, leptospirosis (Weil’s disease), pollution, strong currents, tides, waves, hypothermia, marine life injuries, submerged hazards and adverse weather. 
2.5.6. Photographs, video and sound recordings of You and team members may be taken during the Event and used by the Organiser for publicity, promotion and commercial purposes (including on websites/social media) without payment or further consent. 
2.5.7.  Participation in the Event is entirely at Your own risk. 
2.5.8. You will communicate these risks, disclaimers and Terms & Conditions to every member of Your team. i. You warrant that You have full authority from Your club and every team member to accept these Terms & Conditions on their behalf, and – where any player is under 18 – You have obtained prior written parental/legal guardian consent. 
2.5.9. By ticking the acceptance box, You confirm that You have read, understood and agree to this disclaimer in full.
 
3.      Tickets / Registration 
3.1.   All registrations (“Tickets”) are subject to availability and these Terms & Conditions. Purchasing/completing registration constitutes acceptance. 
3.2.   Tickets are electronic registration only. Your name will be recorded by Us; entry is granted on the day upon verification (proof of identity and Swim England membership may be required). An automatic acknowledgement email will be sent immediately, with further Event information from [email protected].
3.3.   It is Your responsibility to check registration details immediately upon receipt. Errors cannot always be rectified after submission.
 
4.      Price & Payment 
4.1.   The price is as stated at the time of registration (inclusive of applicable taxes). 
4.2.   No registration is confirmed until full payment is received.
 
5.      Changes to Event 
5.1.   The Organiser may alter the published programme, format, timings or Venue where reasonably necessary (e.g., safety, weather, or regulatory reasons). Reasonable endeavours will be made to notify registered participants.
 
6.      Refunds, Exchanges & Cancellation 
6.1.   Tickets/registrations are non-exchangeable, non-transferable, non-deferrable and non-refundable in any circumstances, except as set out below. 
6.2.   If the Event is cancelled or significantly curtailed due to adverse weather, pollution, water quality, or other factors beyond Our reasonable control, no refund or compensation will be payable. 
6.3.   If the Event is cancelled prior to commencement for any other reason, We will endeavour to refund the registration fee (less any unrecoverable expenses, such as administration or third-party costs). No further compensation is payable. 
6.4.   If the Event is postponed to a new date, registrations will automatically transfer unless You notify Us in writing within 7 days of the postponement announcement that You wish to cancel, in which case clause 6.3 applies. 
6.5.   These Terms do not affect Your statutory rights as a consumer. For information, contact Citizens Advice or see https://www.gov.uk/consumer-protection-rights.
 
7.      Liability 
7.1.   Personal arrangements (travel, accommodation, etc.) are at Your own risk. Liability for cancellation, rescheduling or material changes is limited to the refund policy in clause 6. 
7.2.   The Organiser is not responsible for loss, theft or damage to personal belongings (no secure storage is provided; valuables should not be brought). 
7.3.   Personal risk is further addressed in clause 2.5. 
7.4.   The Organiser maintains public liability insurance. Swim England “Compete” membership provides personal accident and liability cover. You are strongly advised to arrange Your own travel and personal accident insurance.
 
8.      Cancelled / Rescheduled Events
8.1.   It is Your responsibility to check whether the Event has been cancelled, rescheduled or altered (via Our website/email or official channels). 
8.2.   We will use reasonable endeavours to notify You using the contact details provided, but do not guarantee receipt before the Event date.
 
9.      Data Protection 
9.1.   We process personal data (Yours and Your team members’) in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and Our Privacy Policy [insert link or note: available on registration site / request via [email protected]]. 
9.2.   By registering, You consent to Us using data for: (i) Event administration and Swim England verification; (ii) safety/emergency purposes; (iii) sending essential Event updates; and (iv) the media consent in clause 2.5(f). 
9.3.   Data will not be sold. It may be shared only with trusted processors (e.g., email providers, insurers, Swim England), or as required by law, under strict agreements. 
9.4.   You have rights to access, rectify, erase, restrict, object or port data. Contact [email protected]. Deletion requests are actioned as soon as practicable after the Event (subject to legal/insurance retention needs). 
9.5.   Read Our full Privacy Policy before registering.
 
10.  Void Registrations 
Any registration obtained in breach of these Terms is void. Attempts to use it may result in ejection and legal action. No refunds for void registrations.
 
11.  Restrictions on Registration
 Registration may be limited to a maximum number per team/club (notified at time of booking).
 
12.  Conditions of Admission / Participation 
12.1.                  The Organiser may refuse entry/participation or require departure on reasonable grounds (health & safety, licensing, void registration, etc.). 
12.2.                  Examples include (without limitation): behaviour affecting others’ enjoyment; threatening/abusive conduct; intoxication; failure to produce ID/membership proof. 
12.3.                  No refunds for refusal/ejection due to Your actions. You must comply with all staff/steward instructions.
 
13.  Restrictions & Prohibitions
13.1.               By attending/participating, You consent to filming, photography and sound recording for Organiser use (including commercial) without payment (see also clause 2.5(f)). 
13.2.               No unauthorised sponsorship, promotional or marketing materials may be brought in or distributed. 
13.3.               Smoking/vaping is prohibited except in any designated areas.
 
14.  Health & Safety 
14.1.               You must comply with all statutes, safety announcements, Event rules and Swim England safety guidance. 
14.2.               Read all pre-Event safety information provided (via email/registration site).
 
15.  Force Majeure
 The Organiser shall not be liable for failure to perform obligations (except payment refunds under clause 6) to the extent caused by force majeure, including (without limitation) acts of God, war, terrorism, riot, fire, flood, extreme weather, strikes, government acts, or third-party injunctions.
 
16.  Governing Law & Jurisdiction
 These Terms and any dispute connected with the Event are governed by the laws of England and Wales. The parties submit to the exclusive jurisdiction of the English courts.
 
17.  Severability
 If any provision is held invalid or unenforceable, the remaining provisions continue in full force.
 
18.  Entire Agreement 
These Terms (together with Event rules, safety information and Privacy Policy) constitute the entire agreement. No variation is valid unless agreed in writing by both parties.
